A 62-year-old school minibus driver named Lam So was found not guilty of child neglect in a West Kowloon Magistrates’ Court on Monday.

On April 13, 2016, a four-year-old girl was left on the bus after dropping other pupils at the ESF Tsing Yi International Kindergarten. She was kept inside the vehicle, where it was later stationed at Tsing Yi Sports Ground, Oriental Daily reported.

Lam explained to the court that his responsibility was for driving, while his partner – 65-year-old nanny, Cheung Yuen-yi – took care of the safety of the schoolchildren. That arrangement had worked perfectly in the 10 months they had worked together before the incident.

The Magistrate found Lam not guilty of the charge, accepting the proposition that he genuinely trusted Cheung had thoroughly checked the passenger area and did not leave the child intentionally.

Cheung pleaded guilty and was sentenced to 60 hours of community service in a previous court ruling, according to a report by Apple Daily.
